In this page, we provide our Terms & Conditions in relation to the WAFL’s online shop (Terms). 

By using our website and services, you acknowledge that you have read these Terms, understand them, and agree to be bound by them.

You represent by using our website and services that you are at least 18 years of age or have permission from a parent or guardian to use our website and services. You warrant that you will not use our website, services or products for any illegal or unauthorised purpose.

All content on our website, including text, graphics, logos, and images, is the property of WAFL or its content suppliers and is protected by Australian and international copyright law, and may also be protected as a trade mark, service mark, or under other rights and laws.

The content and material referred to above must not be copied, reproduced, published, stored in a retrieval system, altered or otherwise used in any form or by any means, in whole or in part, without our prior written approval, or the approval of the relevant copyright owner.
 

4. Intellectual Property

We are the sole and exclusive owner or the licensee of all intellectual property rights (including patents) in our website and services and in the material published on any of them. Those works are protected by copyright and trademark laws and treaties around the world. All such rights are reserved.

You acknowledge that your use of our website and services does not convey any interest of a proprietary nature, and in particular, does not transfer any interest in any intellectual property (or patents) of WAFL. 

You represent and warrant to WAFL that you will not take any action that harms or diminishes the value of, and goodwill associated with, our intellectual property.

To the maximum extent permitted by law, WAFL takes no responsibility and assumes no liability for any direct, indirect, incidental, or consequential loss or damage resulting from your use of any of our services or any products provided through our website.  
 

6. Changes to Terms of Service

We reserve the right to edit these Terms at any time and without notice to you by posting changes on our website. The version of Terms published on our website from time to time is the current version and will bind all users. 

We recommend that you check the current Terms before using our website. If you do not agree to these Terms or any changes to them, you should immediately cease using our website.

You are responsible for regularly reviewing information posted online to obtain timely notice of such changes. Your continued use of our website after changes are posted constitutes your acceptance of the amended Terms.


Refund Policy 

1. Australian Consumer law

As a consumer you are entitled to certain guarantees in respect of goods and services. If the products provided by us have a major failure, you may reject the products and at our sole discretion we may issue you with a refund or exchange or repair the products or allow you tokeep the products and seek compensation for any drop in value. If the failure is minor, we may repair the products or, at our discretion, we may replace the products or refund you within a reasonable time. This does not affect your rights under Australian law.

2. Conditions for Refund/Exchange

We accept refunds or exchanges within thirty (30) calendar days of purchase, provided thatgoods are returned to us in a saleable condition with original proof of purchase. 

For a product to be in a “saleable condition”, it must be:

• in its original packaging, including with instruction manuals and all accessories; and

• unworn, unused, unassembled, in its original condition with original ticketing (where applicable).
 

3. Process for Refunds

To initiate a refund, contact us. 

Products returned must be received within 28 days from the date you notify us of your intention to return the products.

Once your return is received, we will inspect the product’s condition and will send you an email to notify you that we have received your returned product and notify you of the approval or rejection of your refund. We will not accept returned products that are not in saleable condition (for example, products that show any signs of having been worn or washed, including where the products are stained or otherwise marked or damaged, unless we determine such returned products to be faulty). If a product (other than a product returned due to being faulty) is returned to us that is in an unsaleable condition, we reserve the right to refuse your refund. Alternatively, we reserve the right to reduce your refund value to reflect any reduction in the value of a product.

Approved refunds will be processed, and a credit will automatically be applied to your original payment method within 14 days.

4. Faulty Goods

If you receive a product that is faulty, or you discover a fault with a product purchased from us, please contact us.

If we accept that the product is faulty, we may in our discretion and subject to applicable law, offer you a repair, replacement (either of the same type of product, or an alternative productof similar value or equal value) or a refund or partial refund. Our decision on this will depend on our assessment of the fault.

If we do not accept that the product is faulty, we shall inform you of our decision. Any decision by us does not affect any other consumer rights you may have under law.

5. Costs of return

You will be responsible for all costs associated with returning your product (such as shipping costs). Such costs are non-refundable.
